Implementation of the Merchant Shipping (Control of Harmful Anti-Fouling Systems on Ships) (Amendment) Regulation 2022

The Merchant Shipping (Control of Harmful Anti-Fouling Systems on Ships) (Amendment) Regulation 2022 (the Amendment Regulation) will come into operation on 1 January 2023 to implement the amendments to the International Convention on the Control of Harmful Anti-Fouling Systems on Ships, 2001 (AFS Convention) as stipulated in resolution MEPC.331(76) adopted by the International Maritime Organization on 17 June 2021.

Pursuant to the Amendment Regulation, most of the new control measures in relation to a ship’s anti-fouling system containing “Cybutryne” under the amendments to Annexes 1 and 4 to the AFS Convention are applicable to all vessels (i.e. seagoing vessels and local vessels).

For a vessel of 24 meters or more in length engaging only in non-international voyage, the paint certificate of the hull, usage record of paint in shipyard, or declaration on hull’s anti-fouling system signed by the shipowner or the shipowner’s authorized agent for inspection and recording by relevant officers during inspection/checking must be kept on board as evidence of proof that the vessel concerned complies with the latest requirements under the AFS Convention.
